Nevada Supreme Court adopts the increased-risk test
The case is Rio All Suite Hotel & Casino v. Phillips, 126 Nev. Adv. Op. No. 34, ___P.3d___(September 30, 2010). Even if a risk to which the employee is exposed "is [not] qualitatively . . . peculiar to the employment," the injury may be compensable.Bottom line - this case is a win for Nevada...
